Hi All,
Served tenant S21 & Thought everything was going quite smoothly, until now.. tenant has asked for he's deposit a month before he moves out!
I've explained if he wants to move out today I can then get that started today, but a deposit would be given back at the end of the tenancy.  But No, he's moving into a different property 31st Dec but he needs the deposit back to start the new tenancy up front and cannot  move out of this property until he has this..
Hes also forwarded a message on to me asking who he's deposit is with and he should have a customber reference number which suggests someone is telling him what I should be doing, I've previously giving him all these details, and have replied back to him stating I will send them to him if he cannot find them.
He was also short last months rent which he did say he would pay, but has said today he had to fix the toilet and now only owes me £10! I've previously said any repairs to let me know and I will get someone round (we have a guy that does our repairs for us)

Am I in the right to think he gets the deposit back after the tenancy ends?

Any suggestions?
Many Thanks in advance

Hippogriff

Yes, tenancy ends first, deposit is returned later. Tenants need to be able to cover this expense while they're renting. They can't just have one deposit that transfers between Landlords. I hope you can prove you gave the Tenant the Prescribed Information, and Terms and Conditions of the scheme used, for the deposit?

The Tenant neither does repairs themselves, nor unilaterally deducts rent owed in return. I may ask for receipts for materials and labour, from a professional, and, if they existed and were forthcoming I might be tempted to accept (for an easy life).

Hi Hippogriff,

Yet again great advice.
Yes I can proof the tenant was giving a full copy of terms conditions and and all the info needed, he signed to say he has received it all, so I'm covered there.

Will need to see him again beginning of Dec, collect the rent, I have no doubt in my mind he will become aggressive when I explain to him again regarding the rules with the deposit.

Just need this tenant out now.

Many Thanks as always
