Hi all im new to this forum

I have a person renting out my house and his 1 year ten agreement is up ....

He wants a rolling contract is that a good thing or bad ?

Shall i get him on a rolling contract with same terms ..... which is a 2 mth notice period etc

Hi witham75,

It would depend on your tenancy agreement, as the rolling contract is an extension of the existing agreement. So if your current tenancy states the tenant needs to give only 1 months notice, then that is the notice period the tenant need to give. The only way to extend this notice period would be to have a new tenancy agreement signed for a further 6 months with the new clause of 2 months notice period, then allow the tenancy to roll over.

Now it is up to you as a landlord as to whether you accept the tenant going periodic. There are pros and cons and ultimately it would boil down to your circumstances and what your future plans with the property would be. If you would pref the security of knowing your property is rented for the foreseeable future then sign them to another 6 or 12 month contract. If you have plans to potentially sell or move back in within the next 6 months then a periodic tenancy may suite you better.
