Hi Everyone ,

I have put this Topic as this is the last hope for me to get property back.. I have correctly severed S21  2 months before the end of contract with proof of delivery of notice delivered via Post office and personally deliver to letter box of property. ( All necessary docs given before serving the S21)

We have 1 week due for End of contract and now understood that tenant was advised by council not to vacant the property until court order.  Tenant hasn't even paid rent for last 2 months!!   So I am looking for some advise to fill the accelerated possession of property.  Does anyone has done this before or know who to fill the form correctly?

How can I  find sample form for guide incase any question I don't understand?

Any help will be appreciated.

Do we have to Send Cover letter to explain the situation  as well  ?along with Form 5NB for Accelerated possession...

I have read on various sites that  we have to send 3 copy of each ( application form N5B , EPC ,How to rend guide , Gas safety , contract , etc etc)  Really ?

or it is just 3 copy of  application form?

Can some one confirm ?

You sound like you need to retain an organisation (or solicitor) to support you in this process - or, indeed, do it for you.
You can't rely on a forum for this kind of advice, there's every chance you'll be given the wrong answer.

These forums are great for advice and support, but these are very basic questions and, if you get it wrong, your claim will be thrown out.

This is for information to other landlords it might help.

When you go with S21 + Accelerated possession.    I talked to county court customer service. They will need 04 copy of each  means the Form + Any contract and other document you submit.  Also you need to give Cheque of court fee now 355  to  HM Courts and Tribunals Service.


1)  For Court record.
2) Goes to Tenant  ( They have 14 days to challenge it)
3) Comes back to you ( with detail of court claim reference no )
4) I am not sure why they asked 4th ?

I am awaiting court decision it has been 7 days now since they received the documents.  keeping finger cross!!..

Hi All,

Wanted to give you an update on my case..  I am still awaiting court decision for my S21.. earlier court has raised issue on address as in my contract street name mentioned but my S21 I did not put the street name  Just post code ,town, and apartment detail... Which sucks!!!! what does it make difference bloody  whole UK has unique post code for each address , We had to send address clarification letter to judge , it Joke..!! Its been 6 months since S21 application for Accelerated possession. This is my first encounter on country's judicial system but I lost all Faith in it.. 

Finally tenant left the flat in eviction fear but handed over keys to neighbor without paying couple of months rent and left the flat damaged and messy.. which needs complete renovation .. .

Bottom line..  Honest tax payer ,Law abiding citizen ( Landlord) is not supported any system... either council / court /police or any system of country...

Post codes are not per address, each postcode is a section of a "notional" postman's delivery route.
I live in a village, so there are only three properties in my post code, but in a town or city, it's likely to be 10 properties or more (and flats multiply the number of properties per postcode).

There's a lot wrong with the legal system for landlords when it comes to possession claims, but you're expected to be able to fill in an address properly if you want a judge to make a court order about it.
Not sure you can blame the legal system for that one.

 I have put address of the property as per Land registry... now tell me what's wrong in that???  it has flat no / Building name / post code and town name..

its definitely Blame to legal system where they took 6 months without any out come after serval follow and phone call with them, where they claim  accelerated possession for quick outcome... 6 months!!!!  Shame on lazzy ppl.

I don't have to tell you what's wrong with that, the courts have done that already.

The court system is falling apart because of years of underfunding - there aren't enough buildings, people or judges.

Currently the (median) average time between submitting a possession claim and bailiffs returning possession is 22 and a half weeks, and timescales are the lowest they've been since the pandemic.
I think your expectation is probably unrealistic, because, given the issue with the address, the timescale doesn't sound too bad.
