Taking tenant to court for rent arrears but failed to maintain property

Hello

I have possession order court date. My tenant is in arrears by just over 2 months. She hasn't just not paid for 2 months she's always paid something but just short by bits the last year or so. I haven't requested the rent arrears either by a formal letter to her. Does this matter?

I originally gave section 21 but then gave a section 8.

My concern now is I have stupidly failed to maintain the property.

I have had one boiler check done in 3 years.

I have left a leaky roof which has caused a very bad mould problem in the bathroom and one of the bedrooms.

There are also some other minor issues which tenant has mentioned but being honest I have just disregarded due to me selling my property and waiting for exchange.

How will all this sit in court as I'm sure she is going to attend and give her defence..

Sounds like you're the tenant writing this but hey ho.

From the list of basic failings above have you even protected the deposit properly and given the T the requisite paperwork?

This is my first time being a LL. I put the deposit the correct scheme yes.

In this thread (i.e here) we have the (alleged) landlord asking what to do about their impending court case (section 21 expired, then section 8  ) to evict their tenant, who is just over 2 months in arrears but the landlord has not maintained the property or done gas checks or dealt with the leaky roof, etc.
