Hi All,
My Dad was a landlord and died a few weeks ago and I have inherited his tenants! One of them hasnt paid rent since August (Dad was too sick to deal). As far as I can see, it was an AST that expired in October 2013. I want to evict her ASAP. Is the best way to serve a section 8 notice? I'm not sure as she is now in a periodic tenancy I assume?
I also think my Dad would have served her with a section 21 Notice (but I cant find it).
Any help would be much appreciated!
Many thanks

Riptide

If the Section 21 has been served then as you say section 8, I'm pretty certain you'd need the section 21 though and also where is their deposit?

The Landlord

If the tenant's deposit is secured, then serve a section 21. It's a lot less complicated than serving a section 8, and assuming it's served correctly, the courts should give you possession without any problems.

Thank you. They didnt pay a deposit. A guarantor signed the rental agreement though.
