My 1 year tenancy agreement finishes within 14 days , I don't want to sign new one. Tenant doesn't want to move out. I need to serve section 21. Now tenant wants new furniture, claiming current furniture's state is very bad and not suitable for use (bought 5years ago!). Do I need to buy new furniture if I would like to evict him?

If they're on their way out seems pointless to do so.  There's no real legality surrounding the situation, just obligations.

No.

Even the question being asked doesn't make much sense if you think about it. In what possible world would a Landlord have to buy new furniture if they wanted to evict a Tenant? Issue the Section 21 as you want to do and say "au revoir", hopefully without too much trouble (the Tenant is moaning about the contents, but doesn't want to move out... maybe thinks they hold the cards... show them that they do not and say you welcome them going, don't let the tail wag the dog). Even if the Tenant wanted to stay on, and you were happy with that, there's no obligation for you to provide new furniture.

Thank you for your respond.

I spoked to two lawyers today. One has same advice as yours but the other said that due to the eviction process taking months and months I might be contra sued by the tenant for not keeping furniture in good condition. Brrr

Riptide

They would say that as they are lawyers!  Unless you've left them without heating and cooking facilities I really wouldn't worry.  You should have issued the section 21 months ago though.

No chance. Proceed with eviction under Section 21.
