Should I start proceedings before he goes?

The tenant owes 3 months arrears,some going back several months.Section 21 has been served,he is due to leave late Feb.The agents can give me his employer's address and forwarding address,but I am unsure if he will get the court claim served on him,he is very flakey indeed.I know I will probably not get paid anyway,but want him to have a CCJ on his record to help others in the future.Should I start action while he is still in my flat?

If you serve court papers on him whilst he is in your property he may well take retribution on your house. Best evict him first then you know exactly what he owes you to put on the court paper. You can then give him a full schedule of rent arrears.

Yes,that's true about the possible revenge.Years ago a very similar young guy in another property staged a disgusting "dirty campaign" with the help of some charming mates.The cleaning,new carpets and painting cost hundreds,not covered by insurance.Have a good Christmas-I am trying to forget the stresses of being a landlord for a couple of days.Thank you for taking the trouble to reply.
