Section 8 and applying to court

Hi all

My tenants will be into 2 months arrears next week and I would like to issue them with section 8 tenant eviction notice.
What would I like to know is if they pay me some money before I apply to court if I can still go ahead or do I need to wait until they are 2 months full in arrears to make an application?

Another question, do I have to issue another section 8 or just wait for them to be into arrears to apply to court once the notice has already issued in the first place.

I am just concerned that they pay me some rent and I have to start from scratch.

Any advice will help.

Hi I have just been thru' this scenario.  Its not just as easy as serving a Section 8 notice.  But to answer your question Yes the tenants must be 2 month in arrears before you apply for a section 8 Notice.  Before you apply you must be able to show that you have discussed ways with the tenant in which the tenant could repay the debt.  I used the PCOL system and although not that easy it is better than the paper system and cheaper.  Provided you have time to deal with it there is little point in getting a solicitor involved.
