Hello,

Section 8

The tenant has been living at the propety for 1 year - the estate agent has sent them a new tenancy agreement fixed for 1 year - they have stopped paying their rent and their mobile numbers are not working. I am very concerned I will need to wait until end of tenancy agreement Dec 2023 before issue a section 8 and 21 as I don't have a break clause in the tenancy which means one year no rent. Can I stil issue a section 8 if 2 months rent arrears during a fixed tenancy agreement?

Come on Aileen!, it might sound sad if you hear this kind of stuff on the radio, but of course you can... that's what Section 8 is there for. Section 21 is where you're limited like you possibly think. I'd be beating these Tenants down, their eyes sunk, in smoke-dried faces... they'll be so resigned as to what their fate is! That said, Section 8 can be evaded, by paying a little down, or counter claiming for something, just like fairy gifts gone in the sky.

Thank you so much Hippogriff :D, the judges rules are getting so strict for landlords - I was in court via section 21 (sitting in tenant) in October and the judge wanted paperwork going back to 2012 prior to I owning the property - luckily I had all the documents.

Why did they want documents going back to before you had the property?
