I have previously posted about my tenant whose rent was due on 5th Feb. He stated he thought it was due on 15th and got the numbers wrong. Still didn't pay till 28th Feb. He then paid agent extra to take monthly payments to the 14th month. He didn't pay March at all and April's is due on Sunday this week which means on Monday 15th April he is 2 months behind. So I decided to issue a S8. Non payment and back rent are the only mandatory grounds I have though there are a few discretionary ones like letting oil tank run dry despite being reminded and leaving boiler on with no oil.
Having filled in all the paperwork I then discovered that after his 14 days to appeal, if he puts 'some' money in towards arrears he can get away with it because he is no longer two months behind. Has anyone else dealt with this situation? It hardly seems fair that he could pay say £100 and the S8 would be rejected.
This is the final straw. When I finally get rid of him, I will not be renting out any longer. The law does not protect landlords; iyt is all geared to helping the 'poor' tenant.
He is not poor by the way, he goes on holiday regularly and is out every night according to his facebook page - spending my rent money.

This is why issuing s21 is the best way to get him out.You could have served both together.21 does not require grounds,so is far less open to manipulation.

To be fair, this is emotive... the law is balanced and protects both sides. However, think about the risk / reward profile of the two parties... the Landlord risks most but stands to gain most.

All the Tenant gets is a roof over their head and the positive vibe they, undoubtedly, get from knowing that they're paying-off someone else's mortgage for them.

I didn't think I could issue a Section 21 because he has only been in since Jan 5th and his tenancy is for 12 months.
