section 8 & 21

Hi All,
Does anyone know how much it costs to serve either a section 8 or 21 and go thru all the stress of trying to get someone out of your house, also the time it takes. thank you all. :'(

Probably 4-5 months if the tenants are unwilling to leave and play it out to the bitter end.

sending section 8/21 with at least 2 months notice
going through the courts to get an order of possesion
organising bailiffs

Can't really comment on costs ... not been through the process myself

Before you issue the section 21 make sure that the tenants have the required prescribed information first or it will be invalid. I am having to issue one again - 2 months notice. If they do not get out then a possession order will need to be served . . . . costs depend on the solicitors . . .I think all in all it will cost me around 2,500 0r so but not entirely sure yet. All this to get tenants out who have destroyed my house. UNFAIR! Very stressful!/. GOOD LUCK

hi armin and julie,
thank you very much for your advice, i don't know what i'm going to do because before i started renting this house out i knew nothing and did not protect the deposit as i did not know about anything. i have since protected it but i know now this is going to cost me dearly as the tenant is being horrible and making threats with prosicution. she is not going to leave the house without a fight and i have no money to pay for court or to pay her as all the rent she has paid went on much needed repairs.  she now keeps on holding back rent and i a month behind but makes sure she never gets 2 month behind. i just want her out now but just don't know what to do and am frightened of serving the wrong papers only to have it all thrown back at me. any advice?

My advice is to google the hell out of the subject matter and spend a few days doing nothing but research and keep notes then compile yourself a course of action. You are facing a protracted battle to get rid of your tenant and as you have no money you need to do much of the leg work yourself plus need to gather knowledge to be able to verify that anyone else involved is not cocking it up. Say when you trust someone to get the dates on a section 21 notice right.

I am in the same situation. My tennant owes me nearly 4000 and he is in loads of debt elsewhere. He is going on a debt relief order so I do not know if I will ever get the money back and I am hoping he will just leave. I didnt protect the deposit either so I will owe him 5 times the amount if he finds out about this policy but the solicitor says it could come off the the 4000 he owes me. I have asked him for this months rent and he cant give it to me as the the housing have stopped his money saying he has been over paid. This will lead to another grand if he leaves by the end of the second month and if not, I just do not know what to do!!!

armin, thank you for the link, i have started googling the hell out of everything and am (i think) storing alot of knowledge i am a member of landlordzone and have asked a few people for there advice but at the end of the day it boils down to money. i am hoping she will pay the rent til january then i will have a bit of money to ask a solicitor to draw up the forms for me. i will keep you posted..

To serve S8/21 you do not need a lawyer or an agent. You can do it yourself if you know which part of the Housing Act to quote, if not you can get a online company which cost about £170 for a single piece of paper and then it would cost, i believe £179 for the court application which you can fill out quite easily within 10 minutes or if you get a online company to do it, it will cost round £180. Not sure about the bailiff cost but i think this is shown on the court application form.

You can go down to your local county court and ask for an application for free or download it off the net. I think there are two type and the fast track will be quick and i think they both cost £179.
