Hi, hope someone can help. Can I serve a section 21 notice if I have not taken a deposit? Usually I do take a deposit and rent is payable in advance - however, the tenant is dss (who pay rent in arrears) - and she suggested instead of paying a deposit upfront - she would give me the money she had as an advance payment of rent (as specified in the ast) and save up for the deposit whilst she was living at my property - to which I agreed!(as she said she couldn't afford both the deposit and the advance payment) Subsequently I have not received a deposit. I now want her out of the property but can I serve a section 21 notice without a deposit? Advice would be greatly appreciated.
Thank you

AFAIK you can't serve a section 21 if the deposit hasn't been secured in an approved scheme, no deposit = no need so you should be good to go.

If you have no deposit to "protect" you have no issue.

Issue away.
