I have had a tennant in my property for around 18 months. He got into debt I have I been silly and let his rent arrears get out of control. He was discussing getting the rent arrears paid off by the British Legion but now it has been passed to Citizens Advice. They have told him to ask me for a section 21 to be issued. Although he is not currently in any contract I have dated 2 months in advance. As the housing benefirhave stopped paying him, his debt is increasing and he has not paid anything last month and due again next week. If he stays till 28th October this is another £1000 i have lost. I have asked him for the rent and he says he is going to tell cit advice I am harrassing him and I do not know what to do. He is going on a debt relief order. Will I be paid even a few pound a week? Hello Gaynorrobbie,

My advice is to look at the blog about Section 21s and be absolutely certain you fill in all details correctly, especially the date.  This is normally two months, based around the date the rent payment is normally due.  So depending on exactly when you issue the notice, it might be longer than two months, and never less than.

If you get the date wrong, then the law considers the notice invalid.  And you heve is re-issue and start again, so gaining another two months of never-to-be-paid debt.

And you have secured the deposit, haven't you...?

No, I didnt know anything about it. I spoke to my solicitor and he said I can owe the tennant 5 times the amount which would be 2500 but he is going to owe me 4000 by the end of it so if he sues me I would have to take the money from what he owes me.

I am just hoping he will just leave and if I get the money back its a bonus, if not its a learning curve. I do not know if I will even get the money back from a debt relief order anyway? The reason it has dragged out was he was told that the Britsh Legion would back pay his debts. I even had confirmation they were looking into it but they have now passed it on to Citizens advice.

I have just realised that I only took £450 which was a months rent, therefore I didnt actually get a deposit so will I be ok?
