Who's downpipe?

I'm renting out my property and there is a downpipe at the back which I was convinced belonged to my neighbour (its a terraced house) all my guttering is black and a black down pipe goes on my side of the kitchen roof... All her guttering is grey and the grey downpipe runs smack bang on the boundary of the two properties and its been broken a while. Water is splashing out all over the place and has caused my pebble dash to come away :( I called the neighbour about this and she insists it is my downpipe. How can I find out who it belongs to? I attached a picture. Its all green and slimy now as this is from summer :( My tenants are unfortunately her cousins and I contacted them a week ago about getting a builder in to fix it (me paying) and they haven't even bothered to call back. They also still have my gas safety certificate from November!! (which I paid for and they can't be bothered to pass on). So now I'm pretty annoyed with the whole family. Do you think its mine or hers? How can I find out?

Hey if its damaging your property its your downpipe!! its only about £20 for a new one. where is it leaking from?

My advice is to get your own builder in as its landlords responsibility for such repairs and it's open for abuse money wise if you let the tenant do it.  If the pipe is bang in the middle of the two properties it belongs to both of you, but if the damage is getting bad just get it done.

Lord landy is right.  It will be penuts to fix.  It will be causing damp problems which could cost thousands to fix.  Stop spending your life worrying about who's pipe it is.  Just get on and do the fix.  You're the landlord.  You are responsible for fixing stuff, not your tenants.
