Managing agent withholding my rental payments

I am having a problem with my former managing agents Whitegates, Walton Vale Liverpool, for the past several months I have been receiving invoices with incorrect referral dates, incomplete rental payments etc, and to cap it when the tenant has paid in extra by mistake they have then refunded the tenant and charged me commission on their mistake!

Two weeks ago I complained (not for the first time!) about their inefficient management and book keeping, Anyway after my last complaint I received an email from the principal of the agency in which she stated "I will fully reconcile your account today and then pass back to you to either manage yourself or contact an alternative agent"

So needless to say I have now engaged another agency to manage my property.

However Whitegates have failed to pay me either the shortfall in my rental income nor refunded me their management fee for the period October to November which they have charged me for yet reneged on the management of the property, (there was a scheduled property inspection yet they said they no longer managed the property and did not carry out the inspection!

I have written several polite request to their office yet received no reply, so what do I do next? Is there a small claims court or do I write the property ombudsman? Or threaten them that I shall do either of those actions in the hope they pay me?

Another problem I have is I am resident in Australia! All advice appreciate, many thanks

Hello bernier,

Whitegates are in TPO.  First step will be to contact Whitegates to say you are dis-satisfied and offering them a final opportunity to resolve problem in a sensible time-frame before you move your complaint onto the Ombudsman.   TPO won't proceed unless you can demonstrate you've done everything possible to exhaust discussions with the agent.

Hi Guys
well after sending the agent at least 5 politely worded emails we have now sent an email informing the agent that unless payment is received this week we shall be making a formal complaint to the head office of the franchise company and also to the TPO,

Of course still no reply!

I have sent whitegates have failed to reply to any of my emails sent to them over the past week and I am now in the process of writing to the TPO explaining this,
