Hi.
I served my tenants with Section 21(1)B notice. It was dated 01/01/17 and the end date was 28/02/17. It was signed on the 01/01/17.My tenants took this to the council, as they are after a council property. The council rejected the notice because the end date should have been 01/03/17. :(
My question is: What do I do now?
They also asked if the tenants signed the AST agreement after oct 15, and whether they signed a new agreement every 6 mths. I said yes, and they have now asked for the gas cert (CP12) and EPC cert for the house.
What relevance does this have? Why have they asked for it?

Thanks in advance for all your help.

The Council don't have the power to reject a Section 21. Only a Court can do that. That said, understand a couple of things... your Section 21 may well be incorrect, the Council's job is now to frustrate your efforts in evicting these Tenants.

They, also, have no right to request anything from you. But you should have these things, and the Tenants should.

Just another challenge of taking on LHA Tenants. One day no Landlord in their right mind will.

Thanks Hippogriff.
I'll have athe gas cert by Monday(you're absouloutely right - they should have had it anyway - just laziness on my part I suppose) and going through the paperwork when I bought the house I've found the EPC cert as well. Do you know if I'll need to issue a brand new section 21 notice - dated 06/03/17 with an end date of 07/05/17.
And as they are now out of contract, does that make a difference. Thanks

Am I inferring correctly that you never presented the Tenants with a GSC and EPC? Does the GSC exist, but they did not have it, or do you not have one until Monday?

Apologies for the late reply.
I've always had the EPC but not given it to tenants. Didnt have the gas cert but will have it Monday.
