In a block of 12 self contained lets - with the owner of the entire block living in one of the flats - would you issue an AST to a tenant in one of the other flats  in the block? Or is this a letting outside of the Housing Act 1988?

When it isn't.

The terms, self contained, block of flats, etc are all sufficient to me to clearly say this is not a "lodger"

I don't think you have a choice... unless the Tenant is a Company or something like that... then you could use a non-Housing Acts agreement.
