problem tenants and legal points

Hi, here is one that i don't know what to do with, any advice welcome.

My husband and I own a buy to let property. Our tenants have moved out and without my knowledge he has rented it to his son, who has obtained rent from the council, as he does not work. He has moved in his girlfriend with her child and now her brother has moved in. They did not pay rent in advance and have been there two months.

Apparently there has been a tenancy greement signed and delivered to the authorities (council) to secure rent. This rent does not cover the full price of the rental therefore her borther has now moved in. The rent should be £1350 per month and with no deposit either. So rent should have been paid on first day into property and twice since. So far just received £800

They do not work and take drugs, we are behind with payments to mortgage company as well . Any thing illegal with the tenancy agreement? I have not had a copy of the rental agreement come to our house, so not sure if there is a valid one as I would have thought the council should see mortgage details and my name is lead mortagegee.

Forgot to say my husband suffers from major deressive disorder and is prone to illogical things like this.

I have checked on some websites and seen that i could issue a section 8 to quit ground 14 for the drug misuse and ground 11 for rent arrears. Also found a leaflet on Tenants and Drugs for landlords, this quotes,section 8 of the misuse of drugs act 1971. What is interesting is that if you are a landlord, know about drug abuse and do nothing you can get prosecuted.

If any one can help with this I would be very grateful, thanks
