when I changed my tenancy agreement with my tenant  we left the deposit in the same deposit scheme with the agent we agreed this would be ok,I did not   
know that I had to show all the information again,He as turned into the tenant from hell to me and the neighbours.When I have served him with a section 21 notice he knows about this ruling and is finding it all very funny in fact last week he chased me along the street with a video camera trying to get my reaction.Please what can I do.

You could return the deposit in full and then serve a valid Section 21, then move to evict. In the long run you will win and he will be kicked-out.

If you have the grounds to do so (you said he's a tenant from hell), you could serve him with an eviction notice, a section 8. You can serve those without the deposit being protected and/or the PI.

Thank you I am quite scared of him now and had to call the police he got a fine.He seems to spend his time reading all the rules and texting me about I wont get him out so to hear you say I will is a boost  I think I will try the section 8 because he owes me three months money now and is awful to the neighbours. Thanks sorry I wrote it twice thought I had done it wrong.

Sounds like an awful situation.

You can serve a section 8 if he owes you 3 months rent! You should have served it after he was 2 months in arrears to be honest.

Will I be able to send his awful text and police reference numbers to the court.Should I stop the section 21

If you're evicting him based on arrears, none of that is relevant. If you want to evict him for other reasons that's relevant to those issues, then yes, I assume so.

Your Section 21 isn't valid until you return the deposit, so it makes no difference. But in any case, you can Serve a 21 & 8 at the same time, makes no difference.

we sent the section 21 but because he knows about the superstrike should I go straight for section 8 and not wait for him to get in touch with court  if so do I have to cancel section 21

You don't need to cancel anything. They're totally separate notices, not related. Send the section 8 ASAP.

Thanks you do make me feel better I have been a bit like a rabbit in headlights.The agent who is serving this for me says to get neighbours statements just in case he pays also police report seems to be waiting until next week for some reason meanwhile I get sicker and sicker will let you know outcome this tenant just scares me not sure what he will do or say.But you give me hope thanks
