Hi my tenant paid up 6 months in advance as failed credit check

Tenant advised leaving gave two months notice to vacate at 6 months break clause as per contract

tenant leaving early, paid for 6 months vacated after 4 months.

Agent advised need to give a refund pro rata if I get a new tenant, thinking this was in contract emailed tenant will give refund pro rata, this gesture of good will is not in contract , agents opinion. But this pro rata refund was not included in contract.

Some items broken in property minor damage not more than £70 - £100 around bath seal and kitchen cabinet door. As tenant advised will not repair and will go to court regarding deductions from there deposit, as thinks the things broke due to poor workmanship?

Tenant emailing agent cc me in asking about viewings? I sent I nice email to  agent to direct my tenant to me that they have nothing to do with our contract, agent diplomatically said no , will still give ex tenant info regarding my viewings as I owe them money pro rata, I seem to have a third party in my contract with my agent? My ex tenant.

I am very new to this, I checked out the tenant and wrote my own inventory did not know I needed an independent clerk, the check out would cost approx £100 so might offset against minor damage.


I emailed tenant to confirm they surrender the property they emailed back confirmation and gave me the keys. Agent advised that they needed to sign a deed of surrender and that both of our confirmation is not strictly legal and they could still be in possession of property all utilities have been returned to my name from surrender date.

So my my questions is do I owe tenant any money if a new tenant moves e.g pro rata what has been paid
Do I have possession of the property with our confirmation emails.
Why is the agent so tenant biased, our contract in introduction basis only they are not managing the property?
Should I get my keys for the property from the agent and no longer do business with them.?
