35yrs doing it

Hi, I gave access to tenants in May 2013 to rent my house. we never drew up a tenancy agreement. They have paid rent fine since. I can't recall obtaining a gas safe report  on or prior to May 2013, but i did do one in March 2014 and handed that to the tenants. I havent requested a report be done since. So I guess I have an undocumented Assured shorthold periodic tenancy as the rent is payable monthly. I am considering issuing a S21 Notice as i wish to regain my property for my personal occupation again. Am I stuffed as a result of not having done a further gas safe report in the last almost 5yrs ? If i now get a report done, will teh s21 notice now become valid ?

As the tenancy was granted before 1 October 2015, compliance with gas safety requirements is not a prerequisite to serving a valid s21 notice. Non-compliance with the gas safety requirements is a criminal offence by itself though.....

If OP "never drew up a tenancy agreement", I very much doubt they gave the required notice prior to the start of the tenancy under ground 1.

Possibly but as there was no agreement they might have done it verbally,

The notice must be in writing.

it may even be in an old email

Possibly, which is why I wrote "I very much doubt" not that there couldn't had been one.

Decent tenancy agreement would have it in the terms

Well yes, but that's not what we are talking about here.
