DHHS Tenant in Arrears

We have a DHHS tenant, the council pay the majority of the rent and the tenant is meant to pay the rest, however the tenant is now 3 months in arrears. We have previously issued the tenant a section 21 notice, but the council advised the tenant not to move if she didn't have another property to move to. We want to sell the property, what's the best route to 'evict' the tenant?

If your section 21 is still valid start possession proceedings.  Council will advise tenant to stay put until the bailiffs come a knocking.

I think Riptide is assuming you are beyond your fixed period (a fair assumption given the brevity of your post)

Can you confirm this?

Here's an update, I  have just heard from the council that they will  be paying me directly into my bank, the housing allowance, Yippee! however the tenant gets away with not paying her share Boo. But I feel a lot more relaxed now

The tenant continually refuses access to the property even for gas safety checks etc. We have gone to the property at the drop of a hat when needed. They are now 8/9 months in areas with with the 'top up rent' the councils pay the majority directly. We have served a section 21 a couple of years ago, so it has expired. They were on a 6 month tenancy agreement but have been there for about 3 1/2 years.
The council have been no use. We just want to gain repossession so we can sell the house.

Why do you think your section 21 has expired??

Oh you're right, I just read that a Section 21 issued before 1 October 2015 doesn't have an expiry date - that's good to hear.
