Hi All
I have a couple of really good tenants who, two years ago, signed on a 6 month AST which then became static periodic. They have now got married and they were wondering if the name  (well the surname of his now wife) on the original AST needed to be updated.

I don't know the answer to this since Mr was a lead tenant and Mrs was listed as tenant no2 but the contract made clear that they were jointly and severally liable for the tenants obligations etc. So this suggests that my contract with them was a contemporaneous document which still stands regardless of whether there has been a name change, and despite any changes regarding the legal obligations that exist between the two of them.

Am I correct, or is there a need for some kind of addendum?

Advice would be appreciated
Thanks

Mortimer

It doesn't need to be updated, but as they're good tenants I would advise you to do as they ask and sign a fresh AST in the new names.

Thanks Mortimer

My understanding is that a key benefit to the tenants of Static Periodic is that the tenants would only need to give notice if one period (1 month in my case). I normally issue AST for a period of 6 months which could therefore keep them committed for a fixed period. I have no objection to this 😬 but in anticipation, I just wonder if the same thing can be achieved with some kind of addendum?

Would an addendum a legitimate alternative to another AST?

Thanks

You don't need any addendum. They've told you what their name is now. Update your own record and you're fine.

No. No need to do anything regarding the AST.

Statutory.
