Tenant splitting with partner

My tenant wants to split with his unmarried partner and move into my other smaller property. His agreement is up for renewal at the end of the month and it is in his name only. Where do I stand ? She has 3 children and it looks like she cant afford the payments on her own. Does she now have to move out or has she some legal redress or right to stay ?

No legal right to stay.
Has he handed his notice in?
It's not coming up for renewal, it's about to go periodic.

So far he's verbally enquired about my second property and has requested a meeting tomorrow.

I mentioned his first six months was up about six weeks ago but he seemed very evasive. I now know why !!!

You either have to serve notice or he does.  1 month for him, 2 for you.  If he decides to hand notice in and she stays then you need to apply for a possession order.

Also meet with the wife.

It may be that with 3 kids, she can get housing benefit, this is regular money, and if they keep the house nicely its fine.

Also with the Hubby still on the periodic agreement for the first house, he is in effect still acting as a guarantor. He may not like this, but its not up to him at the end of the day.
