Letting Agent witholding rent

My son has been letting his house to the same tenants for several years.  He has used a Letting Agent who has managed the property over that period.  The tenants are now moving out (they have given 4 weeks notice) and the agent is withholding one month's rent from my son (the landlord).

The explanation being that it is to cover costs.  This is separate to the deposit which should be returned in full (subject to the usual post tenancy checks)

The letting agent has collected the rent each month and deducted their fee plus any other costs ie PAT tests on a month by month basis. 

Any ideas why the letting agent should withhold rent.  It may be in the original agreement but that was signed over 7 years ago.

Ask them for proof of there legal right to withhold this rent.

On my understanding this sort of this is very very common. Agents know how to charge.

The original agreement will still be in force,
unless there is something in the agreement to cause it to time out.
