The letting agent I was using failed to refund my tenants the excess deposit beyond the 5 week cap, when they signed a new AST 12 months ago. I only discovered this when I recently took over management of the tenancy from the agents, and am myself in the process of arranging a refund of the excess deposit. The Agents' breach of the Act put me at risk of receiving a financial penalty. Would I be in my rights to claim a refund of the letting management fee, or proportion of, I paid to the Agents for the months they were in breach of the Act before I took over?

You can try,but I can tell you it will get you nowhere.You could complain to any professional associations they belong to, but I doubt if that would bring you satisfaction.
