Damage to property from flat upstairs.

Hi,

looking for a little advice!

The bathroom in my buy to let has been damaged by a leak from a bath in the property upstairs.  I have found out that this leak has been going on for over a year.  The landlord has claimed he has now fixed the problem but was very surprised when I asked for his insurance details as I am looking for him to pay for the damage to our bathroom.

Is there a process to follow?  I have heard a few stories regarding this landlord and would be surprised if he had any sort of insurance.

Any advise would be much appreciated

We have had the same problem. We spoke to our insurance to let em know. We (yes,  WE) had to make a claim on OUR I
and WE had to pay the £250 xs.

The leak damaged one wall, one side the bathroom, the other the bedroom. Both rooms required replastering and the bathroom tiles had to be ripped off. Note, we had completely refurbed the flat 18 m ago.

The tenant has now been out of the flat over 3 months.

Even better, the newish tiled bathroom...they can't source the tile. They will not retile the bathroom ...only the affected areas. So, we are annoyed at best.

That's terrible! 

I will call the owners bluff and see what happened but prepare myself for having to foot the cost.

sorry wrong post...

but am I to understand that this is a freehold property being discussed? I have the same problem, but in relation to my flat which is managed by managing agents. The building insurance covers all the flats in the block.

Sounds like you own a flat. Surely the managing agents of the development (the people whom you pay the service charge to) are the ones to call. They are the ones who have taken up the building insurance on your behalf.
