Fully Managed Service With No Inspections

Hey Guys.

Need a bit of guidance on something that has happened.

Long story short i have been in a 12 months AST Contract with a local agent. To fully manage my property at a set percentage.

The AST has been terminated at the 6 month point by the tenants with the appropriate 2 month notice served.

I have a good professional relationship with the tenants, as any issues have been sorted by myself asap when i was in the country, such as plumbing, boiler and so on.

The agent agreed verbally to inspect the property asap (as the last tenants where pigs and caused damage) and do a 4 month full inspection.
I live abroad and i wanted feedback on how the tenants where looking after the property.

As i turned out the tenants where very good and in deed did look after the property for the term of the 6 months.

I conducted a check-out inspection last week myself using the professional itinerary that was done on check-in.

I asked the tenant had the agent at any point done a visual or photographic inspection of the property.

The answer is NO, and i have not received and information from the agent regarding any inspections during the period.

So i payed the agent a visit, asking for him to produce dates and a report of the 4 month inspection on the property.

He hasnt to date, and at the time his face said it all.

Where do i stand legally if NO routine inspection was carried out by the agent in a fully managed AST Contract?

My thoughts are it is a breach of contract, plus worth punching him in the face for lying again to my face.

Just fire the Agent? Take a bit of pleasure in it as well...

My experience, thus far, says that all Agents are universally rubbish. If you could survive without one, I would recommend that, but you may not be able to.

I wouldn't expect to get much back from the Agent... they're slippery and, unless you enjoy a good scrap, not really worth the effort. Just my two pennies.

Agent has been fired and current AST with them expires in a week.

To my knowledge no routine inspection was a carried out during the 6 month fully managed service provided by the agent, so is a breach in contract.

i have given the agent a week to produce evidence of an inspection, which if by any slim chance he does, was also done without 24 hour notice to the tenant.

Long story, my opinion of agents hasn't improved. they are all leaches..ha.

i will pay the agent today and see what he say's.

If no evidence provided today of a 4 month routine inspection i will ask for refund of difference for 6 months fully managed in relation to 6 months part managed service.

Will be a fun encounter :)

I hate agents.....rant over.

going direct with tenant....no agent needed.

It's amazing isn't it?  I have also had a "fully managed service" from a supposedly reputable local estate agent who I thought would be soild,  but basically, if I haven't  checked and done it myself it hasn't been done.  I am now binning my agent and the tenants he found for me, who are subletting, doing what they like to the house, etc.  and doing it myself. Oh well, live and learn
