Hi everyone,
I am a new member and would like some advice . I have owned a property for a year and a half and always used an agent to collect rent and manage the property, although I have no problems I have come to the conclusion its money I could spend better . How do I go about taking over management of the property at the moment the rent is paid by standing order and I couldn't ask for a better tenant , should I contact the tenant and tell him my plans or leave it to the agent to handle, also what,s the procedure re the deposit that's held does it get transferred or stay where it is.Do I have to do a new tenancy agreement.
Any help appreciated .

Martha

Step 1. Do you have a contract with your agent.  Hopefully you do.  What does it say about termination.

Hippogriff

As above, but you don't need a new AST, you will need the deposit transferring to a Landlord ID you set up, you must inform the Tenant so money goes directly to you. Prepare for the Agent to tell you you can't even do this... all in their terms of business, right?

Obviously you will be offering the Tenant a rent reduction for the decrease in the level of service? Hahaha!

Hippogriff

Alternatively...

"Dear Agent,

It's not you, it's me. Although I'll always have a special place in my heart for you it has recently begun to feel all wrong. Yes, at times, our business relationship felt like it was the best thing that had ever happened to me but now, it pains me to admit this, my need for you has faded away."

Martha

...... I just can't be the landlord you want me to be....

;D

Your comment didn't increase the helpfulness of the answers in any way shape or form.  What would you suggest the OP does that would be helpful?

You need to interact a bit. I asked you a question about contracts which you completely ignored.  ::)

Carver isn't the OP! OP is a OPW.

Carver is having agent issues as per his other thread, I think he was after answers here.

Can i ask, where do i find out the legal information about not having to draw up a new Tenancy Agreement when changing the property from being agent managed to self managed please?

boboff

Yes you can.....ask that is... Lol!

Umm, if the original agreement  names just you and the tenant, and another agreement covers your relationship with the Agent.

You wont find anything.

The original agreement  still stands, irrespective of  the agreement or otherwise you have with your Agent.

Does that make sense?

If these "ifs" don't apply then its another answer you are looking for.. not droids, these wont be the right ones either...

Shelly

That is interesting. I emailed my letting agent earlier this week and politely gave them notice thanking them for their services (??!).  This is what I received.

"Just to confirm you wish to give us notice and take over the management of the above property with the tenants in situe??
If this is the case I will write to your tenants, you will need to arrange a new tenancy agreement with them as ours will become void and you will need to apply for a deposit scheme so that we can forward the deposit to you."

Looking at the conversation above, is it correct that I just need to obtain copy of the tenancy agreement from my tenants?  I wasn't sent a singed copy from my letting agent.

Hippogriff

Was it only singed or could it have been burnt completely?
