Periodic Tenancy

Hi,

My tenant requested that we enter a periodic tenancy last year, which we agreed, because it is mutually beneficial to our future plans too. A notice period of two months was agreed by both parties. We would like to give our 2 months notice...can this be from any date, or does it have to be from the date the tenants moved in. We intend to give notice shortly, which will in all reality, be 10 weeks notice.

Any advice would be gratefully received.

What's in the tenancy agreement? Some state notice is from the date the rent is due, others from the date notice is given.

The terms of the tenancy agreement relating to notice only have effect if the tenancy went periodic as a contractual periodic tenancy, if the tenancy became a statutory periodic tenancy they're ignored. In either case, any agreement between you outside the tenancy agreement is probably irrelevant as well.
