I need to give notice to my tenant

Hi all,

I'm hoping for a bit of advice

My marriage has broken down and I need to move back into my property with my 2 children.

I have done everything by the book so far with all gas safety Etc.

The tenancy changed to a periodic tenancy in August. I need to move back into the property in January.

What is the process from this point forward?

First of all, I suggest that you adjust your expectations. January isn't far away (particularly given that there's a period over Christmas, and December generally, when not a lot happens).

I'd suggest speaking to your tenant before going formal with notices. You're asking them to leave their home (for all the right reasons) and it might help things to understand what the situation going forward is likely to be. Having less pressure and accepting the situation might make things easier for everyone.

If they're not helpful or immediately start talking about going to the council for assistance, I'd go formal with notices as soon as you can. If you can, I'd use a professional eviction service - it's remarkably stressful evicting someone (particularly if life is already stressful) and easy to make a mistake that can cause delay and cost.

Spend some time making sure that you have done all the things that need to be done for a section 21 notice (search for nearly legal's section 21 flowchart - or use the sticky thread here). Have a look at your tenancy agreement to see if you've served notice to allow the use of ground 1, under section 8 of the housing act 1988 (there's usually a reference to that if it's there at all).
