How to continue a tenancy agreement, but overseas issues

Hi,

I am currently living in Australia and I am leasing a premises in Belfast to my nephew for his business.

The lease is due to expire soon, but I really don't want to deal with the solicitors anymore nor do I want the hassle to fly all the way back to Belfast to sign another agreement.

I trust him enough for him to continue occupying there.

Can I simply write and scan a permission letter to him for him to continue using the premises until further notice, and for the meantime we will continue the previous tenancy as if it was not expired yet.

How should I write this permission letter? What content does it require?

Assuming Northern Ireland has the same laws,you don't have to do anything.He will now be on a periodic-sometimes called rolling-tenancy.Nothing changes regarding the terms of the original lease.You will still need to give him two months notice if and when you want to,and he is required to give one month.If he has played fair with you there should be need for further legal fees.A letter from you won't hurt either.

In Northern Ireland it would become a periodic tenancy and so you should not do anything.
Writing a permission letter is unnecessary and potentially detrimental to your position depending on how you draft it.

[I am not overly familiar with NI law though and you may want to investigate how easy it would be to increase rent on a periodic tenancy and there are other obligations in NI such as mandatory registration etc]
