can i claim rent back

me and my ex partner moved into a rented house which i paid a years rent in advance and deposit ,, relationship has broken down ive moved out he says he is going to move out also .. I have proof in my bank account i paid the years rent in advance which started on 19th dec 2014  and runs till 19th dec 2015 .. so if hes out by may is there anychance i could get back the 7 months left of the rent ive paid in advance???

Claim back from who, the Landlord?

Somewhat doubtful, unless they are very nice to you. You signed up for a fixed term contract of 12 months and you must have paid the rent in advance because there were issues with your credit rating? At the moment you've left, but your other half remains in the property. Your other half only indicates that they will leave - that may not even happen. You are jointly and severally liable for the rent.

The Landlord should not suffer just because your life hasn't turned-out like you hoped. However, if you both move out and then the property is empty, and the Landlord manages to re-let the property, you should be due an equitable amount back - after all, the Landlord cannot get paid rent for the same property twice. You must be prepared to sacrifice the costs of re-marketing and re-letting though... it's not fair to just expect the rent back for the time the property is empty.

Have you broached the topic with your Landlord yet? Is your Landlord even aware you've moved out?

i understand i dont want the landlord to loose out , and yes my credit rating isnt that good ,, Just what bothers me is i fully paid the rent my ex is living there rent free and im being made homeless ,, is there anyway i can get him out ???

also i dont know my landlords details to contact him ,,,my ex works full time i am on DLA

Two things, where is your contract and surely you know who your landlord is.  Go to Land Registry and find the owner of the house as a starting point.
This is a very curious situation, can I ask why you paid for a full year in advance.

Can't believe you don't have contact details for your landlord. What if something went wrong/emergency or there were repairs that need doing.

I expect the OP means that they'd not paid attention to the details of the Landlord when moving in and the AST is likely sat somewhere in the house.

To progress any further the OP is going to need the contact details of the Landlord... otherwise you're effectively talking to no-one. Is there any way you can get your ex-partner out? Difficult. You signed a joint contract and that contract doesn't care where the rent money came from, just that any debts (counting rent money in that) are to be serviced by both people named on there. You have the right to be in the property too, I would add, but I understand you may not wish to return... but you would hope this could be done when your partner is at work?
