Section 21 or Ground 8 Notice

Hi,

I rent out my property on a 6 month AST which started on 1st May 2015.

My tenant is in arrears by 3 months.

I know I can serve either notice but am concerned that even though the Ground 8 notice potentially gets him out sooner, there could be less risk with a S21 notice. I can then chase in small claims court for the rent


Can anyone give their opinion on what to do?

You can serve both. Believe it or not.

Both Sections... 8 and 21.

Serve both 8 and 21
Use multiple grounds in the s8 (there are 17 but likely only 3 of them will apply)
But then if he doesn't leave have a really hard think about which you pursue through the courts -- you CANNOT pursue both.
The s8 is earlier potentially but fraught with danger.
S21 much safer

I have now served both and my tenant has paid me one month's rent plus and extra £50... but thanks to your advice and that of Hippogriff I have the S21 to fall back on.
