Help – Tennant has committed suicide

Hi Guys

Really need some advice if anyone can help me?

My tennant committed suicide in my property and before he did, he had contacted relatives to tell them.  Obviously family rushed round to try and prevent his actions but when they got there the front door was locked.  Understandably they smashed the door down to get in.

My question is would the damage to my door be covered by the tennant's deposit?  Although the damage was done directly by the tennant, his actions did?  I know that this must sound awful, but i am looking at paying out £600-£700 for a new front door, not to mention £200 excess to go through my insurance!

Can anyone advise?

I think you have another problem.  I would suggest you might to (anonymously) contact the deposit protection people as they will now need to deal with the executor of the estate (assuming of course the deceased is the only named tenant).

The cost of the front door is highly likely to be recoverable from the deposit.  The actions of the rescuers are directly linked to the actions of the tenant. Legally a claim for damage might be initiated against those causing the damage but courts are unwilling to find against rescuers on policy grounds and so will always lay the blame by allowing a tortious claim at the party causing the need for a rescue  i.e. The tenant.  Common sense in this case would prevail and no such action would be necessary.  The deposit proection folks will be able to guide as they are the arbitrator in most cases.

However the real problem will be how to recover any sums from the deposit if the tenant is deceased....
