looking for some help i look after the letting of my dads house as i have poa (powers of aterny)
i have a problem .the tenant in the house is trying to play me .
the ast has finished and i would like to hand the house over to a letting agence who are more than happy for my tenants to stay how ever the rent is being incresed by £40 .the tenants do not like this and have told me they will not pay it . they have also told be that i want them out i will have to evict them so they can get a council house there words not mine . can youhelp were do i stand ?

If the tenancy has ended I think you can give notice to get the tenants to leave - 2 months notice - but it is important you use the correct procedures and forms, more info here

Why are you getting a letting agency to look after it? Also if you have good tenants there why not leave them be, consider the costs involved in using an agent. At the very least they will be taking 10% + VAT on the rent. Just on the extra £40 that equates to £6 meaning you are only £34 a month better off. Now if the property is vacant for one month, how much rent will you miss out on? Is it worth it?

How do you know you will get good tenants the next time? From previous experience some agencies are great, most do bugger all for the money and leave you high and dry if there is a problem.

Finally what about trying a bit of negotiation with the tenants and meet them halfway ie yes you are good tenants and I would like to keep you, but market rate is £40 greater. I'm Power of Attorney so I am obliged to act in my dad's best interests, what about we meet halfway £20 increase.
