I had four tenants under a single tenancy. One out of the four tenants moved out and was replaced with a new tenant.

Unfortunately, I forgot to register the deposit for the new tenant (the other three were still registered). The tenant who was not registered is now threatening to take me to court. Do I stand a chance of defending this given that this was a genuine mistake, the other three tenants were protected and i have always treated the group the same with regards to the deposit ?

Thanks

Kam

Hippogriff

Did you protect the Deposit?

No.

Do you stand a chance of defending why you didn't protect the Deposit?

No.

Hope that helps.

Hippogriff

Oh... I missed that you said it was a genuine mistake.

That changes everything...

No, it doesn't.

Sorry.

Settle... that's what I'd do... don't go to Court. Assess your minimum and maximum exposure, try to settle, learn your lesson. [Try to] Consider it expensive Landlord training.

It's not my field of expertise by any means but there might be some wiggle room if it's a joint tenancy, in terms of who has the right to bring a case to court.

As Hippogriff says, though, your best it is to settle. 1x the deposit would probably do it. You won't even notice it.
