One of my landlords didnt take a deposit from their tenants but now wishes to serve a section 21, will they be able to do that?

The landlord can serve it, and the tenant may leave. But if the tenant refuses to leave and the case goes to court, the Judge won't give the landlord possession because the Section 21 won't be valid.

The landlord has to hope/rely on the ignorance of the tenant to get away with it.

No problem at all serving a Section 21 if a deposit wasn't taken at all. The problem arises if a deposit was taken but not protected correctly.

Oh yeah, I misread!! As Hippo said, if no deposit was taken, the Section 21 will be valid!
