deposit

I have fell out with a letting agent, he is holding a deposit with D.P.S. the agent will not respond to any of my letters regarding the deposit,  I am evicting a tenant due to being filthy, agent is friendly with the tenants in question.  I have know registered with D.P.S. and asked for them to get agent to transfer the deposit, the agent on being asked to trasfer said no I'm the controling agent.   What can I do as the D.P.S. seem not to be able to help me, has anyone come accross this.  Please help.  :-\

Just dont use agents. Us landlords are just as capable of f**king things up as these high flying rip off agents.
who holds the deposit is irrelevant really. you can issue the sec 21 for any or no reason. just make sure its the right one for during or after the 6months initial period of tenancy.
if the tenants want their deposit back then they will have to go through the agent. if the place needs cleaning send the bill to the agent and they can get it back from the deposit themselves via the dps.

or cancel the agreement with the agent in writing recorded delivery and insist they transfer deposit to your dps account.

this is how i do it.  meet a prospective tenant from an advert (about a fiver in the admag). look them in the eye and sum them up yourself. tell them its deposit plus 1 months rent in advance. ask to see some wage slips and ask about their work ie be bloody nosy.
references are a waste of time. if they had/have arrears where they are now the landlord wants them out so he wont tell the truth. 

also tell them that if the transfer doesnt go through for rent you will issue an eight week notice to them immediately. if i have a doubt when i am going to pick up rent and think i may not get it, i take the section 21 notice with me already to hand over. by paying late they have immediately broken the terms of their tenancy end of. do not accept any form of bullshit excuse.

just a thought but have you proof that the agent even did the deposit. if he's being evasive he might not?

Thanks for getting back Lord Landy, I am going to get the possession order from the court any day now, if the house is left with issues and I send the bill to the agent as you suggest and he ignors me again, can my next move be to take him to court for the money, I can already prove he won't acknowledge any correspondence from me as he has sent back mail saying "return to sender unopened" don't know how he new who to send it back to if he had not opened the letter, your correct re agents most of them are complette pricks, and this one is not even clever.

I will send him a recorded letter asking to transfer the deposit but he will ignor me again, this I'm sure, or should I do this by email can he say he did not receive an email from me, not to clever with computers so not sure how emails work.

ps. I did check regarding if he had lodged the deposit and yes the prick did.

just as much as you had contract with him he had one with you. non communication is a clear breach of that contract.

yes do the recorded for court purposes if needed.
