Fixing parking

Hi, we have a mews  property with 1 parking space adjacent to 2 more. They Have sunk slighted and need repairing but the other 2 owners won't engage.

How best to resolve this please? Many thanks,Nigel

In theory you could pay for it all,then take the other 2 to the small claims court for their share.I had this with some roof problems,and the roofer was able to make my side o.k.The neighbours never did rectify the problem on their part.If you can't just have your parking area made good,you will either have to put up with it,or cough up.People like this are such a pain.

If the parking space was mine, and had sunk, and needed work (that would be something I would want to decide)... I certainly wouldn't allow someone to turn-up and then start work on it, though?

I suppose that is another aspect.The other people might be strapped for cash,and don't think this is a priority.It depends what ,if any,are the risks of just living with it for now.Do they agree that it ideally needs doing right away?

Many thanks all. Yes it needs doing but not vastly urgent. The other landlords don't seem to want to fix it . We'd happily pay for it ourselves but we can't fix ours without fixing the other 2. And we don't have permission to fix theirs. Does anyone know wait usually happens in these situations please?

I had assumed that they were refusing to pay their share.If they refused your offer to cover the total cost,realistically there is not much you can do.Would I be right in wondering if there is some history here to explain their attitude?

Thanks all, we haven't actually offered to pay the total cost but will imminently as we seem to be getting nowhere.... as it's Stands they don't want to get it fixed. Would anyone kindly know the legal stand point at all please? Eg we've tried every method but if they still refuse access to fix their parking space...(negligence-wise etc)..

You are worrying about the legal implications before you have done the most obvious thing.If you are prepared to pay for the work,they may well be more than happy to grant permission.Your first post did not give the full picture.If they still refuse,then personally I would leave it until there is some risk to their own safety or cars,and they will probabaly change their tune.Getting into litigation over such matters just lines the lawyer's pockets and causes much ill-will.
