some help please

Hi,

I rented my property 18 months and the tenants have been great, no problems, paid rent on time etc., This month they have not paid their rent and are now 2 weeks+ late. The estate agent is getting no joy from numerous phone calls/emails promising the rent tomorrow, glich at the bank, salary late etc., and the agents now feel they are getting the run around.

We are on a periodic tenancy as the 6 month assured has passed.

Am I right in thnking that I can give them 2 months notice to vacate? And do I have to do this on the date the rent is next due? The agents are suggesting we give them more time and I am happy to do this, within reason, I have bills that need paying in a few days as well and I can't live in my overdraft whilst waiting for their rent for much longer.

Give them notice, while maintaining that it is a standard procedure.  If they pay, no problem.  If they don't, you haven't wasted valuable time.

Thanks for the speedy response and yes thats what I have asked the agents to relay to the tenants, it could well be a one off and I don't want to cause any unhelpful bad feeling should the rent be paid in the next few days.

What I want to clarify is, is it 2 months notice for the landlord on the periodic tenancy and can I only give that notice on the next rent due day i.e 25 of August.

There is a form of words to insert into the s21 notice which is a copy and paste job from s21 Housing act.

Dangerous to state a date in case you state the wrong date

Also if arrears are 8 weeks you can give s8 notice which is only two weeks rather than 2 months

Personally I would serve both without prejudice to the other

You need to learn this stuff if you are letting houses I am afraid :)
