possible HMO please can anyone make things clear

right from the begining the original tennants who were husband and wife have now seperated i was approached by the brother of the husband and asked if there mother and father could rent the house. It was explaned to me that the wife has gone back to portugal how ever when undertaking work at the property i noticed that there were locks installed in bedroom doors x2 as i worked in the house over a period of 12months whiles always seeing the woman in question always there it emerged that she was living there she also iformed me that she contributes to the rent (sub letting). I have researched the housing act 2004 and i carnt see that she is covered by that it states if they are direct blood decendent or live together as husband and wife.I have been informed that she is commiting tresspass so i have to give notice to the tennants the husband and brother mother and father as we can not directly approach the woman in question as it would acknowlage that she is a tennant. after serving this notice asking her to go as a breach has been committed she has informed local authority and said she has never left the property so now she is jeperdising the elderly mother and fathers contact. Could this living arrangement constitute an HMO as local authority now want to investigate and are saying if its an HMO i need a licence this is only a 2 bed terrace house i dont think this is fair as this has been all under handed and deceatfull what action can i take to remedy the problem also the contract for the elderly couple has been miss placed. Also there has been extensive damage to the property i have had to put right in the intrests of safty broken floor tiles ,nails to hold wall paper up and now an new oven the affected area has only been refurbished only 3years ago . how can i take the house back if an HMO is established can i serve an 21 please help
