Eviction - advice, tips, info please!

I'm hoping if anyone has been thorough a similar eviction they could advise me please:

Section 21 was served end of July, tenants came back saying they needed to be evicted to gain a council house - oh joy!! 

Reluctantly went ahead with this and eviction date was Tuesday and they haven't moved, council told them if Tuesday was the bailiffs date they could temporarily rehouse them but if this was 'just' the eviction date they should stay put!! They've been advised their council house is being refurbished and they should be able to move in on 11th Oct however they will be able to view it before then!!

Q1 - 11th obviously isn't definite for them moving out so do I instruct bailiffs at cost of around £250 when it's possible they'll move out before then anyway or just wait those ten days to see?

Q2 - how do I get they part payment for this month?

Q3 - they were also instructed by court to pay me £360 costs - how do I get this money?

They've caused around £800 damage to the property (longish story but is reason I want them gone) so I was hoping the £650 deposit would pay for this, not the part payment of this months rent and the court costs.

Any advise or info greatly appreciated.

It is disgusting but The Council will not move until Bailiffs are coming, this came about because people faked their way onto housing list by saying they were being evicted and the Bailiff aspect is just them extending it.  The tenant will be forced to pay the Bailiff costs you can apply to the Court for a weekly payment if they do not pay.  Do not count on the 11th, anything could happen, send them a warning that you are instructing bailiffs and they will have to pay those bailiff costs and then do it.

If you want to use deposit for anything but damages and rent you should have asked the Judge to allow it to be used against your legal costs and you should have asked for a daily rate plus interest until they are gone all to be part of the judgement for costs.

You will of course need to track them down, many disappear but as you know where they are now and you might know their movements, e.g. do they take their kids to a certain playgroup or school, then you may be able to track them down in the future.

You could ask for a forwarding address for mail and utilities but they are unlikely to be so stupid as to give it to you.  Take meter readings on the day they leave and call the utility companies and put it in your name until new tenant comes in.

Did they pay from a bank account and if so do you have the details and know when they get paid. If so apply for CCJ and get third party debt order. Otherwise get CCJ if you think they have viable assets that can be pursued. PM me if you want more info
