Tenant Deposit - Help

Hi I did not deposit my tenants money because he never got round to paying the full amount.  However i did deposit his part payment last month.  Is this a good excuse.?
. want him out so how do I serve the prescribed info. on him and get him to sign?  He is an odd beggar so probably wont answer the door and if I post it will swear blind hes never recevcd it.
Also did I read the rules regarding tenanst suing you fro 3 times the amount have changed.?

If you didn't protect the deposit in a scheme within 30 days of receipt (whatever the amount of that deposit was) then you could be liable to pay a penalty of between 1-3 times the amount of the deposit, if the tenant is aware of the rules and decides to sue you. The rules changed last April (originally it was 14 days and 3 times the deposit). To get your Section 21 rights back (in order to get him out) you will need to return the deposit to him.

With regard to the prescribed information, you should send it to him, preferably by recorded delivery or post it through the letterbox by hand and fill out a Certificate of Service to prove delivery. As long as you have invited him to sign it, you have complied with the initial requirements. You are not expected to ensure that he signs it.
