Hello all, I hope you can help.

I have a problem tenant I want to evict. However, the tenant has allowed some of their family to move in with them without asking for my permission. I wasn't aware they were living there full time until recently. But they may well have been there for a while. I have been advised that a section 21 can only be served against someone on the AST and of course they aren't. But I don't think they are classed as squatters because the tenant invited them in? So what are they and how do I get them all out?
Thank you kind people.
Amber.

You serve a section 21 on the tenant and go to court to bring the tenancy to an end.
When the property is repossessed, all occupants will be removed, tenants or not.

Until the tenancy is ended, these people can live there if the tenant has given them permission to do so (unless your tenancy agreement says otherwise and you can get a court to order them to leave [which is next to impossible])

What are they? I'd presume guests.

They are not party to the tenancy agreement and are not paying you rent, I assume.

Guests of a Tenant don't inherit any rights to remain in a property when the tenancy ends. So Section 21 all the way.

Thank you so much, although the situation isn't great that's better than I thought it might be. Hopefully I will be rid of the whole lot of them before too long.
