Deposit after 90 days

Hello everyone

Our tenants have moved out and failed to pay last 3 week rents, approx £700 and have caused damage to the property, approx £500.

£1100 is in the deposits scheme.

We are happy to take no more than £1100 to cover rent and damages as we know getting more money out of the tenants will be difficult.

Tenants are no longer responding to email/phone/text correspondents via the letting agent, they moved out on the 5th April.

After 90 days should we get the deposit back to cover rent and damage or do we need to go via the courts? We have been given confusing and mixed information from the letting agents so i would appreciate any advise you all can offer.

Does that mean it's physically with the deposit scheme - custodial? Or is it actually held by you or the Letting Agent?

If custodial, I would think that you would just be applying for it to be returned - all of it to you - and see whether the Tenants disagree or allow it to go to you.

yes if it is custodial, you put a single claim in against it, the tenants are given a specific timescale to respond and if they don't, the deposit is usually awarded to you.
