Question(s) about County Court Bailiffs

Hi all,

So the big day has come, and the bailiffs will be evicting my awful T tomorrow morning (thank you all again for the help you had previously provided me). I wanted to ask a few questions RE the eviction:

1) Bailiffs will be evicting under a section 8 - is it guaranteed that I will get possession tomorrow?
2) Can the CCB force entry into the property and physically remove my T (bearing in mind she has 3 young children, and her partner will also likely be present)?
3) I will have a locksmith to hand, in the event that my keys don't work or T has bolted the door from the inside. How much power do I have to gain entry into the property? Can I instruct the locksmith to pick the lock or utilise 'destructive entry' while the T is inside if she refuses to open the door?

Basically, in a long-winded way, I'm asking what the process will be tomorrow. I can't find any information regarding this as every search ends in a webpage or document stating what the bailiffs will be seizing - this isn't applicable to me as the bailiffs aren't collecting debt, they are just trying to get possession of the property.

Thanks again in advance if anybody can help me out. I just want my damn house back from this bond villain.

Not been through it so can't help.  Can you call the bailiffs office to ask?

Ray

I'm hoping to give them a call after lunch. Hopefully they'll be able to give me some useful answers but the county court wasn't all that useful!

I think number 1 question is a non question really.  From my basic understanding the point at which a section X would fail would be at the hearing/court stage i.e before the possession order has been granted.  Once the PO has been granted that's that end of things done and dusted.  A PO is a PO and has been granted IMO.

I thought so. I just have this image in my head of the tenant sitting on the stairs with her children, saying "well I'm not leaving". And then the bailiff picking her up and throwing her out the door sideways, before gently escorting the children out.

Hopefully they won't be as stupid as to have made themselves completely homeless and they might be gone when the bailiffs get there, hopefully..................

Update: Tenants were long gone when we arrived. Big cleanup job, but could have been much much worse!

A couple of doors have dents in them (severe enough to need replacing) - but doesn't seem like there was any malicious damage! Definitely better condition than I thought it would be in. Still need to hunt the fool down and slap on an Attachment of Earnings  >:(

Give them time to bed in somewhere and use findermonkey if you don't know where they are.

I'll try this towards the end of february/early march. That'll give it a solid 2 months and hopefully they'll show up on findermonkey!
