Cost of replacing laminate flooring. Who is responsible ?

Hallo everyone,

I have a tenant who would like me to replace the worn out laminate floor. She is covering up the damaged areas with rugs and claiming it is a trip hazard. The floor is 14 years old so can fairly be considered fair wear and tear. But she is also refusing to contribute to the cost, although she wants to remain in the property indefinitely. Am i wrong in thinking a contribution is justified ? Am i legally obliged to replace it at all ?

Any advice would be welcome, thanks.

You are not legally obliged to replace it for purely cosmetic reasons,but if it is causing a potential hazard it would be wise to do so. One would never expect a tenant to contribute to something which is part of your property,unless they had caused damage.If she is good tenant who wants to remain,why would you risk losing her? It is your house,and up to you to keep it in decent condition.

Thanks for the advice. On reflection, i think you're right. She is a good tenant and keeps the house tidy. It just annoyed me a little that she originaly offered to split the cost and then changed her mind.

If she stays in the property she'll end up paying for the floor ... because that's what rent is for.

If she doesn't stay in the property, then why would she pay for a floor that she'll only get a few months' benefit from?

You're not legally obliged to replace it if it's not a hazard in itself. If it's just a bit shabby and your tenant is using rugs to cover the shabby bits, then it's up to her whether they're safe or not. However, if you want your tenant to look after your property, then it makes sense for you to look after it too. You can always bear it in mind when you're negotiating a rent increase anyway.

Your rent payment should include replacement of wear and tear items. You should maintain the property at least close to how you originally let it
