Tenancy end and rent increase

Hi,

I have informed the tenant about the rent increase after the fixed term ends (ends on Jan 2024) and asked their plan whether they would like to renew the tenancy or leave once the fixed term contract ends. The tenants said they would let me know their plan.

Any suggestion on whether to send a formal letter about the rent increase and to fix some deadline for the tenant to notify their plan or state that they have to vacate the property once the fixed term ends?

Unless I know their plan I can't advertise the property and agree with the new tenancy. Just in case they say last minute that they want to continue.

You can't "require" that the tenant leaves the property at the end of the fixed term. You can serve them notice, but that doesn't actually mean that they have to leave. You can use a section 13 notice to increase the rent.

Thanks . I thought section 13 notice to increase rent is for periodic tenancy ?

It is, but when the fixed term ends, the rental will become a periodic tenancy.

You have no need to advertise the property in October. Chill. Do ask them for an update... but after some reasonable time.

Every single time I have imposed a rent increase, I have done it via agreement... never resorted to any kind of Notice. If you are fair with people they usually act accordingly (if your relationship is adequate and you're not trying to shaft them). The time of year for this tenancy is a little problematic, for obvious reasons, but I'd still resist trying to line up all your ducks with urgency - you've given enough time for them to mull it over and get back to you.

Thanks for the suggestion.

I informed them on 10th Oct informally, as they will have enough time to decide and look for another property if they are not happy with the increase. It seems to be a good idea to get a new agreement if they want to continue.
one of the tenants is on a student visa which expires in mid-next year, if tenancy is to continue can I create an agreement for 12 months as a right-to-rent check should also need to be done or just till the end date of the visa expiry?
