Hello,
I have a Statutory tenant who has moved from a 3 bed house into a nursing home and left her
middle aged daughter in the property. The tenancy has already been passed once
and her daughter could become an Assured Tenant but does not want to pay a market rent.
She has offered to pay a nominal sum until she finds somewhere to move to but would her paying
any rent then create a new tenancy? Also does anyone know what Notice to serve if she decides
not to move at all?

She's not your tenant, she's a squatter, to get her out evict the original tenant and she will be evicted at the same time.  All the while arrears will be building up

Don't accept payment, don't acknowledge her as a tenant.
